Liability Release and Waiver Agreement

 

Release Waiver.

Please review the terms below as your participation, or your child’s participation, in any programs, events, or seminars offered, are explicitly voluntary, are at your own risk, and you willingly agree to release AMP Hockey Academy Inc., herein collectively referred to as "AMP", from any and all liability for injuries or related damages.   

 

By registering in these programs or events, you understand and agree to accept the terms and conditions set forth in this legal and publicly available notice; 

 

If you do not agree to these terms, please do not use this website or register for any programs or events offered by AMP Hockey Academy Inc. 

These site terms are in addition to any terms that may apply to you under applicable agreements and terms. Where this site or part of this site contains rules, guidelines, codes of conduct, further terms or other directions to you, you undertake that you shall comply with such rules, guidelines etc. In the event of any conflict or inconsistency, the public website terms shall prevail.

1.0 RELEASEES

AMP Hockey Academy Inc., the AMP Sports Academy, including all respective directors, officers, employees, consultants, agents, contractors, coaches, volunteers, and representatives, and their respective successors and assigns, or any of them in connection with the operation of any and all AMP ACTIVITIES (collectively, the “RELEASEES”).

 

2.0 AMP “ACTIVITIES”

AMP is designed as a multisport development platform and includes a variety of sports, training, activities, events, camps, training programs, education seminars and symposiums, including, but not limited to the following:

Ice Hockey, Sledge Hockey, Roller Sled Hockey, Street Hockey, Soccer, Lacrosse, Wheelchair Lacrosse, Basketball, Wheelchair Basketball, Volleyball, Handball, Wrestling, Boxing, Skiing, Snowboarding, Sliding, Climbing, Running, Ultimate Frisbee, Flag Football, Mountain Biking, Rugby, Obstacle Courses, and Climbing.  Hereinafter collectively referred to as the “ACTIVITIES”.

 

3.0 DESCRIPTIONS AND ACKNOWLEDGEMENT OF RISK:

I am aware that the ACTIVITIES involve inherent risks, dangers and hazards, both known and unknown, that are associated with athletic training, development and competition. I understand that similar risks are also inherent in using equipment associated with the ACTIVITIES, and any other devices, apparatus, or training facilities. I understand the risk of negligence on the part of the RELEASEES, including the failure on the part of the same to take reasonable steps to safeguard or protect the participants from the risks, dangers and hazards, both known and unknown, of participating in the ACTIVITIES. I acknowledge that personal harm or injury may be sustained during my/my child’s involvement in the ACTIVITIES, including, but not limited to, broken bones, head / neck injuries, concussion, dislocations, tendon and ligament damage (including sprains), damage to teeth and dental work, spinal injuries (that could result in various degrees of paralysis), and death. I acknowledge and assume the potential risks and consent to my/my child’s participation in the ACTIVITIES.

 

4.0 CONSENT TO PARTICIPATION  

I/my child have/has been informed that I/he/she is to abide by the rules and regulations including directions and instructions from the administrators, instructors, coaches, and supervisors as imposed on me/my child while participating in the ACTIVITIES.  In the event that I/my child fails to abide by the rules and regulations imposed on me/my child while participating in the ACTIVITIES, disciplinary action may either require that I/he/she not participate in the ACTIVITIES, or that I will leave/be contacted to have my child picked up or transported home at my own expense. I acknowledge that I/my child am/is in good health, and in proper physical condition to participate in the ACTIVITIES, and I acknowledge it is my responsibility to notify the staff of any physical or mental concerns for me/my child which may affect my/my child’s participation in the ACTIVITIES. I acknowledge that the ACTIVITIES may require an instructor, coach, employee, or supervisor to perform some manual spotting or instruction that involves direct physical contact with me/my child and are designed to assist the participant in the safe performance and execution of the skills.

 

5.0 RELEASE OF LIABILITY AND WAIVER OF CLAIMS 

I confirm that I have read the above description of risks and understand the risks involved in participating in AMP ACTIVITIES. I confirm that I voluntarily and freely accept all such risks and choose to participate/allow my child to participate in the AMP ACTIVITIES. I accept full responsibility for my own/my child’s actions.  I hereby agree to waive any and all claims that I have or may have in the future against AMP, and to release and discharge from any and all liability, it’s directors, officers, employees, consultants, agents, contractors, volunteers, and representatives, and their respective successors and assigns, or any of them in connection with or participation in AMP ACTIVITIES for any and all of the following:

- Personal injury;

- Death;

- Property damage; and/or any other loss, damage or expense,

arising from any cause whatsoever, including negligence even if caused by negligence on the part of AMP Hockey Inc. or its agents, or negligence caused by your actions or inactions, those of others participating in the ACTIVITIES, the conditions in which the  ACTIVITIES take place, or negligence of the Releasees, breach of contract, or breach of any statutory duty or other duty of care, on the part of the Releasees, and further including the failure on the part of the Releasees to take reasonable steps to safeguard or protect me from the risks, dangers and hazards of participating in any/all AMP ACTIVITIES.

 

I further agree to indemnify, save, and hold harmless each of the Releasees from any loss, liability, damage or cost which any may incur as a result of a claim, brought by myself or anyone on by behalf, against any of the Releasees.

 

6.0 AUTHORIZATION OF FIRST AID IN CASE OF EMERGENCY AND INDEMNIFICATION: 

I hereby authorize basic first aid to be delivered to me/my child by the RELEASEE’s staff or other authorities. By administering first aid when required or requested, the RELEASEE in no way warrants or assumes any liability in relation to the administration of such basic first aid.

 

I further understand and agree that, in the case of an emergency, the RELEASEE assumes no responsibility or obligation relative to any cost or expense related to carrying out an emergency procedure and/or emergency transportation for me/my child and I agree to pay for such costs and expenses and shall indemnify and reimburse the RELEASEE for any such costs or expenses that it incurs.

 

I confirm and agree that this Notification and Assumption of Risk, Consent to First Aid Treatment, and Release of Liability and Waiver of Claims shall be governed by the laws of the Province of Alberta. I confirm and agree that if any portion of this Notification and Assumption of Risk, Consent to First Aid Treatment, and Release of Liability and Waiver of Claims is found to be void and unenforceable, the balance, notwithstanding, shall continue in full force and effect.

7.0 Indemnification: All participants agree to indemnify, save, and hold AMP harmless from any loss, liability, damage, or cost arising from any claims made by the participants or their representatives.

 

8.0 PHOTOGRAPHIC MATERIAL

I HEREBY AUTHORIZE the Releasees to take my photograph, and to use any and all images of me, including video footage, taken at or in connection with the Activities or Programs. I consent to the use of all such images, photographs and video footage by the Releasees, whether in connection with the Activities or Programs or future similar events, without any compensation to me whatsoever. I HEREBY SURRENDER all rights to any photographs, images or video footage taken of me or my child strictly in connection with the Activities or Programs, which I acknowledge are the property of the Releasees alone.

 

9.0 AUTHORIZATION 

I HAVE READ, understood and agree with the statements in agreement, and by assuming and acknowledging this risk, I completely absolve all RELEASEES from any and all liability for loss, damage, injury or expense that I may suffer, that a third party may suffer, or that my next of kin may suffer as a result of my participation in any of the activities and/or programs offered by the Releasees, DUE TO ANY CAUSE WHATSOEVER.

 

I acknowledge my responsibility to ensure the adequate medical personal health, dental and accident insurance coverage, as well as protection of my personal possessions.  IN USING THIS WEBSITE AND REGISTERING FOR ANY EVENTS OR PROGRAMS OFFERED, I AM ENTERING INTO THIS AGREEMENT I am not relying upon any oral or written representations or statements made by the Releasees other than what is set forth in this agreement.

I CONFIRM THAT I HAVE READ AND UNDERSTAND THIS LEGAL AGREEMENT AND I AGREE TO BE BOUND BY ITS TERMS, AND I AM AWARE THAT BY PARTICIPATING IN ANY AMP PROGRAMS, EVENTS, OR ACTIVITIES I AM WAIVING CERTAIN LEGAL RIGHTS WHICH I OR MY HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS OR ASSIGNS MY HAVE AGAINST THE RELEASES INCLUDING THE RIGHT TO SUE OR CLAIM COMPENSATION FOLLOWING AN ACCIDENT.

10.0. REFUND POLICY 

AMP has a zero refund policy.  If an athlete is seriously injured and cannot participate in the program we will, under certain circumstances, credit the unused amount forward towards upcoming AMP Activities or Programs for the following season. 

 

11.0. PRIVACY

This policy will outline how your personal information is collected and used. By providing us with your personal information and entering your name at the bottom you consent to the policy and use of information outlined herein.
